Ascension Estates is owned by Cashman Capital Corp and operated by Cade Cashman (DRE #02222044) and Kurt Mellinger (DRE #02238998), licensed under Equity Union Real Estate, a California licensed brokerage. In this policy, "we" means Ascension Estates at Equity Union Real Estate.
This policy covers our website, ascensionestates.com, and the Ascension app. It says what we collect, where it comes from, why we use it, who gets it, how long we keep it, and how to use your rights under California law.
Read this before you send us a form, sign in to the app, or keep browsing. The sections below give the detail.
These are the categories California law uses. We have collected each of them in the last 12 months.
Your name, email, phone number and postal address when you give them to us. Your IP address. The cookie and device IDs that our own tools and the tags from Google, Meta and Microsoft set in your browser. A random visitor ID our site keeps in your browser. In the app, your account ID and, if you turn on notifications, the push address your device gives us.
The contact details above, plus a loan balance, if you give us one, when you ask for a Free Equity & Exit Report. California lists these in Civil Code section 1798.80(e).
What you tell us about a home you want to sell or buy: the address, your timeline, the price you expect, your loan balance, why you are moving, who else will decide, and whether you already have an agent. The homes you view, save or ask to tour. The searches you save. If we list your home, the showings, offers and updates we post to your app.
The pages you view, the links and buttons you click, how far you scroll and how long you stay. The searches you type into our home search. The results our calculators show you. Whether you open our emails and which links you click. Your browser type and the page that sent you to us. If you allow Microsoft Clarity, a recording of how you move, click and scroll on our pages.
Your rough location, such as your city or country, worked out from your IP address. We use it to show homes near you and to count where visitors come from. We do not ask your device for its exact location.
Once we know who you are, because you sent a form or clicked a link in one of our emails, we use what you do on our site and in our emails to judge how ready you are to buy or sell and what price range fits you. Our agents use this to decide when to call and what to talk about.
The app signs you in with a one-time code we email to you. We use sensitive personal information only for purposes California allows, such as signing you in and keeping accounts secure.
On many of our pages, our site keeps a random visitor ID in your browser and logs the pages you view and what you click. Until you send a form or click a link in one of our emails, that log does not name you. After that, we join it to your record. The app uses a cookie to keep you signed in. Your browser also stores the privacy choices you make on our site.
Cloudflare hosts our site and app. Cloudflare Web Analytics counts page views and page speed on every page and in the app, for every visitor. Cloudflare says this tool sets no cookies and does not fingerprint your device. Cloudflare Turnstile checks that a person is sending some of our forms and signing in to the app. It reads signals from your browser to do that.
What loads depends on the page, where your browser says you are, and what you choose:
When you send one of our forms, your browser may give Google a scrambled (SHA-256 hashed) copy of your email address or phone number. Google uses it to tell us which of our ads led to that form. It does not include your name, your address or your answers. Your browser does not send it if you have opted out, or if your browser's time zone is in Europe and you have not tapped Accept.
When their tags run, Google, Meta and Microsoft can collect information about your activity on our site and on other sites and apps over time. Their own policies govern what they do with it: Google's privacy policy, Meta's privacy policy and Microsoft's privacy statement.
Companies that work for us get what they need to do that work:
Google, Meta and Microsoft get data through their tags, as described above and under "Sale and sharing". We may also disclose information when the law requires it.
California law calls it "sharing" when a business gives personal information to another company for ads aimed at you based on your activity across sites and apps. It calls it a "sale" when a business gives personal information to another company for money or anything else of value.
In the last 12 months we have shared identifiers (cookie IDs, IP addresses, and the scrambled email or phone described above), internet activity (pages viewed and clicks), and the rough location an IP address shows. We shared them with:
When you opt out, Google processes what it still gets under its restricted data processing setting. Google then acts as our service provider. It still counts visits and tells us when one of our ads led to a form, and it stops using your visits to personalize ads.
We do not sell or share the personal information of anyone we know is under 16.
Some exceptions apply. For example, we may have to keep records the law requires a real estate brokerage to keep. If we cannot do all of what you ask, we will tell you why.
Once you opt out, the link at the bottom of most of our pages reads "Opt-Out Request Honored". The switch, the privacy choices and Global Privacy Control are saved in the browser you use. They do not reach your app account or the records we hold from your forms. To opt those out too, email us. If you clear your browser data or use another browser or device, set your choice again there.
You do not need to prove who you are to opt out.
Email [email protected] or call 805-796-1793. Tell us what you want, and give us the name, email and phone you used with us. To delete your app account yourself, open Profile in the app and tap "Delete my account".
How we check it is you. Before we give out, delete or change information, we match what you tell us against what we hold. We may send a code to the email or phone we have on file and ask you to read it back to us. We ask only for what we need to do this.
Someone acting for you. An authorized agent can make a request for you. Send us your signed permission for that agent. We may still ask you to confirm your identity with us directly.
When we answer. We confirm a request to know, delete or correct within 10 business days, and we answer within 45 days. If we need more time, we tell you why and take no more than 45 more days. We act on an opt-out as soon as we can, and within 15 business days.
Global Privacy Control. We honor it. If your browser sends it, we treat that browser as opted out of sale and sharing before the page finishes loading. Meta and Clarity never load. On most pages, Google gets only cookie-free pings under restricted data processing, and on our articles and similar pages nothing from Google loads at all. Your browser does not send Google the scrambled email or phone. No pop-up asks you to change your mind, and nothing on our site can switch sharing back on while your browser sends the signal. The signal covers the browser that sends it. To apply it to your app account or your records with us, email us.
Do Not Track. Browsers can also send a Do Not Track signal. There is no agreed standard for what it means, so our site does not change what it collects when it sees one. Global Privacy Control, which California law recognizes, is the signal we act on.
Some of our records have a fixed end date set in our systems. Many do not yet. For those, we say the rule we follow.
Ascension Estates may text you about your request, your home value and your report, your appointments, homes for sale, open houses, and tours you ask for. This is when we text you:
Message frequency varies. Message and data rates may apply.
How to stop. Reply STOP to any text and the texts end. END, QUIT, CANCEL, UNSUBSCRIBE, REVOKE and OPT OUT work too, and so does a plain reply such as "please stop" or "don't text me". Reply START to turn texts back on. Reply HELP and we reply with how to reach us. You can also stop texts by calling or texting 805-796-1793, or by emailing us.
Your mobile information. We do not share your mobile number with third parties or affiliates for their marketing or promotional purposes. Text message opt-in data and consent are not shared with any third parties. Twilio, the company that delivers our texts, and FollowUp Boss, our client database, hold your number and your consent only to run our texting for us. The one other place your number can go is the scrambled copy Google may get from our forms, described above. It is used only to measure our own ads, and opting out stops it.
We send email through Resend. You may get:
Every update has an unsubscribe link. Our emails tell us when you open one and which link you click. Links in our emails can carry a code that tells our site the visit came from you. If we got your email from a homeowner list instead of from you, the same unsubscribe link applies.
The Ascension app for iPhone opens the same app you can use at ascensionestates.com/app/. This is what it does with your information:
We use AI services from Anthropic and Cloudflare in parts of our work. Your information can reach them when our staff use them to draft emails, summarize property and market information, read documents such as offers, or answer questions about our own records. A search you type into our home search can also be read by AI so we can work out what you mean.
Human oversight. We do not use AI to make decisions about you that have legal or similarly significant effects, including any decision about housing, the terms on which a home is offered, or financing. Licensed people make those decisions.
Accuracy. AI can get things wrong. Anything we give you that was made with AI help, such as a value estimate or a market summary, is for information only. It is not an appraisal. Check it before you rely on it.
Fair housing. We do not use these tools to target, exclude or treat people differently based on race, color, religion, sex, gender identity, sexual orientation, marital status, national origin, ancestry, familial status, source of income, disability, or any other trait protected by federal or California fair housing law.
Your choices. Ask us how AI tools were used with your information by contacting us at the details below.
Our site and app run over HTTPS. App sign-in codes and links are stored in scrambled form, so a copy of our database cannot be used to sign in as you. Our staff tools sit behind their own separate sign-in. No system is perfectly secure, and we cannot promise that nothing will ever go wrong.
Our site and app are for people buying, selling or owning a home, and they are not aimed at children. We do not knowingly collect personal information from anyone under 13. We do not sell or share the personal information of anyone we know is under 16. If you think a child gave us information, email us and we will delete it.
When we change this policy, we post the new version on this page and update the effective date at the top.
